Summary

The source of substantive law on the offences or crimes against property are found under Chapter XV in the Kosovo Penal Code, known originally as the Criminal Law of the Socialist Autonomous Province of Kosovo. This document was drafted in Albanian, but follows closely the Criminal Code of Serbia.

The goal of this lesson is to provide officers with detailed knowledge and understanding of the key offences of theft, offences related to the basic offence of theft and aggravated theft under the Kosovo Penal Code.

At the conclusion of this lesson, students will be able to:

  1. State and explain the four (4) key elements of the basic offence of Theft under art. 134
  2. Explain the seven (7) Aggravating factors of the offence of Aggravated Theft under art. 135
  3. Identify the elements of the offence of Forest theft under art. 130 and explain aggravating circumstances of the same offence
  4. Name the key elements of the offence of Misappropriation of another's property under art. 139
  5. State the elements of the offence of Misappropriation of a motor vehicle under art. 143
  6. Apply the Definitions of Theft, Aggravated theft, Forest theft, Misappropriation of another’s property, Misappropriation of a motor vehicle
