Summary

In a Democratic Society with its modern law enforcement agencies, the goal is to try to reach an equal balance between the laws of the country, state or municipality and the rights of the individual. In order to protect these rights it is the responsibility of the police/customs and the judicial system to prove that the individual charged with an offence is in fact guilty of that offence. The individual charged with the offence is not required to prove his or her innocence. Because of this, a system of establishing proof must be the primary focus of the Investigator to determine the facts of a criminal act. This system of establishing proof is called an investigation.

The goal of this lesson is to provide officers with the Criminal conduct and criminal liability provisions from applicable law in Kosovo.

At the end of this lesson students will be able to:

  1. Define the Criminal Act according to Article. 8. Of the SFRY Penal Code, and the difference between an act committed in Defence of Necessity art.9. and the act committed in Extreme Necessity art. 10. Of the SFRY Penal Code.
  2. Interpret the significance of the Criminal liability, Intent, Negligence and Liability for a graver consequence and Preparation for the same.
  3. Recognise the characteristics of the ‘Attempt’ art. 19. and ‘Inappropriate Attempt’ art. 20. Of the SFRY Penal Procedure.
  4. Define the Criminal act of Complicity, Incitement, Aiding and The Limits of Responsibility and punishment of accomplices, inciters and aiders
  5. Identify the characteristics of the mode, time and the place of the commission of a criminal act.
