Summary

The purpose of the lesson is to provide proper directions for all officers to take when responding to domestic violence incidents. It establishes the duties of the Regional Domestic Violence Co-ordinators that complies with the Criminal Code and the Criminal Procedure Code of Kosovo and with UNMIK Regulation no. 2003/12 that deal’s with domestic violence issues.

The terms of “domestic relationship” and “domestic violence”, “injured party”, “Suspected” etc, and also the responsibilities of police officers are described and given in the New Criminal Codes (CC and CPC of Kosovo) and UNMIK Regulation No 2003/12 on Protection against Domestic Violence.

The goal of this lesson is to provide the police officer’s with the opportunity to study the legal system according to New Code applicable in Kosovo, (Criminal Code and Criminal Procedure Code of Kosovo, that became applicable on 6 of April 2004) UNMIK Regulation no 2003/12and KPS basic policy on domestic violence, and its mandatory-arrest model and other procedural actions for domestic violence intervention and protection of victims.

At the end of the lesson, participants will be able to:

  1. List the Basic terms mentioned in the New Codes from legal field applicable in Kosovo and in UNMIK Regulation No 2003/12” according to the legal framework.
  2. Identify some criminal acts related to Domestic Violence according to the Criminal Code of Kosovo.
  3. Identify the procedure, which will be applied by the police and the Public Prosecutor in case of Domestic Violence according to the lesson.
  4. State the powers of a protection order for Statutory Protection envisaged by New Criminal Codes applicable in Kosovo and UNMIK Regulation no 2003/12 and Protection against Domestic Violence as stated in the lesson.
  5. Explain three (3) forms of a protection order as defined in the PCCK and UNMIK Regulation 2003/12.
  6. List responsibilities of Law Enforcement Authorities in cases of domestic violence as defined in New Criminal Codes applicable in Kosovo and UNMIK Regulation 2003/12 as defined in the legal framework.
