Summary

Sexual offences are foreseen on chapter XIX – of Kosovo Penal Code and are named as: “Criminal offences against sexual integrity ”. Commission of these offences presents serious violation of sexual freedom and expression of the will of victim in the view of giving the consent for sexual intercourse. This requires serious and special consideration from police officer, from the first response to the interview. The gravity of these crimes also requires maximum effort of the part of KPS to bring the perpetrator to justice, thereby giving a good signal to the community. KPS officers should have a good knowledge and understanding of the relevant applicable law.

The goal of this lesson is to provide students with an understanding of groups of criminal offences against sexual integrity.

At the conclusion of this lesson, student will be able to:

  1. Define the offence-rape based on article 193 KPC.
  2. Define the offence- sexual assault according to article 195 of KPC.
  3. State key elements of criminal offence- sexual intercourse with threat against honour or authority based on article 194 of KPC.
  4. State key elements of criminal offence- sexual abuse by abusing the position, authority, or profession, under article 200 of KPC.
  5. State key elements of criminal offence- sexual abuse of persons under 16 years under article 198 of KPC.
  6. Decribe the criminal offence – inducing sexual acts or sexual touch by persons under 16 years under article 199 of KPC.
  7. State key elements of criminal offence-degradation of sexual integrity under the article196 of KPC.
  8. State key elements of criminal offence –Sexual Abuse of Persons With Mental or Emotional Disorders or Disabilities under the article 197 of KPC.
  9. Describe key elements of criminal offence - Facilitating Prostitution under the article 201 KPC.
  10. Explain criminal offence – Sexual Relations Within Family Units under the article 204 of KPC.
  11. Define criminal offence – Abuse of Children in Pornography under article 202 of KPC.
  12. Explain elements of criminal offence – Trading(showing) Pornographic Material to Persons Under the Age of Sixteen Years under article 203 of KPC.
